We will be talking this week about the Skrmetti case and it's larger implications for the transgender community. Jasmine is an advocate of transgender people establishing a legal change of gender through a court order as one of the strongest protections in these shifting tides of identity documentation.
In December the Supreme Court heard oral arguments in the case of United States v. Skrmetti, a pivotal case currently before the U.S. Supreme Court, challenging the constitutionality of Tennessee's Senate Bill 1 (SB1), which prohibits gender-affirming medical treatments for minors.
Enacted in 2023, SB1 bans medical practitioners from providing treatments such as puberty blockers, hormone therapies, or surgeries intended to assist minors in identifying with a gender different from their sex assigned at birth. Notably, these same treatments remain permissible for minors whose gender identity aligns with their sex assigned at birth.
The plaintiffs, including families of transgender adolescents and medical professionals, argue that SB1 violates the Equal Protection Clause of the Fourteenth Amendment by discriminating based on sex and transgender status. The case has garnered national attention due to its potential implications for transgender rights and healthcare access across the United States.
